Why has the "Green River Ordinance" been replaced?

The ordinance has been replaced to bring the City's regulations more in line with the approach that many other Colorado cities have taken regarding residential solicitation.

Solicitation hours are 9:00 am to sunset.

What is a commercial solicitation?

The recently adopted ordinance includes the following definition of commercial solicitation:

"Door-to-door commercial solicitation" shall mean attempting to make personal contact with a resident at his or her residence, without prior specific invitation by or appointment with the resident, for the primary purpose of:

  1. Attempting to sell, for present or future delivery, any goods, wares or merchandise, other than newspaper or magazine subscriptions, or any services to be performed immediately or in the future, whether or not the person has, carries or exposes a sample of such goods, wares or merchandise, and whether or not he or she is collecting advance payments for such sales; or
  2. Personally delivering to the resident a handbill or flyer advertising a commercial event, activity, good or service that is offered to the resident for purchase at a location away from the residence or at a future time."
What is a non-commercial solicitation?

The ordinance includes the following definition of non-commercial solicitation:

Door-to-door noncommercial solicitation shall mean attempting to make personal contact with a resident at his or her residence, without prior specific invitation by or appointment with the resident, for the primary purpose of:

  1. Seeking or asking for a gift or donation for a public entity or tax-exempt nonprofit organization exempt from federal income tax under 26 U.S.C. 501(c)(3);
  2. Soliciting the sale of goods, wares or merchandise for present or future delivery, or the sale of services to be performed immediately or in the future, with the entire proceeds of such sale to be paid directly to, or used exclusively for the benefit of, a public entity or tax exempt nonprofit organization exempt from federal income tax under 26 U.S.C. 501(c)
  3. Personally delivering to the resident a handbill or flyer advertising a future, not-for-profit event, activity, good or service;
  4. Proselytizing on behalf of a religious organization;
  5. Soliciting support for a political candidate or organization, or ballot measure or ideology; or
  6. Soliciting the sale of newspaper or magazine subscriptions.
Is a commercial solicitation permit required to distribute handbills or advertisements?

A permit is required if a handbill, advertisement or flyer is personally given to a resident. If the handbill, advertisement or flyer is left on the door without contacting the resident, a permit is not required. No handbills or advertisements may be left at a residence which has a "No Soliciting" or "No Trespassing" sign, nor shall a handbill be left on a motor vehicle.

Who is considered a non-commercial solicitor?

A non-commercial solicitor is a public entity(schools, government) or a non-profit organization exempt from Federal income tax under 26 U.S.C. 501 (c)(3).

As a non-commercial solicitor, do I need to apply for a permit or register with the City in any manner?

No. Any person, whether volunteer, owner, agent, consignee or employee who is a nonprofit organization exempt from federal income tax under 26 U.S.C 501(c) (3) or a public entity is exempt from soliciting if a residence does not have posted "No Trespassing" or "No Solicitation".

How can I tell if a commercial solicitor is properly permitted?

Each permitted solicitor must carry a copy of the company's permit and have a City issued photo ID badge.

Are newspapers and magazine solicitor's considered commercial solicitors?

No. Solicitation of newspaper and magazine subscriptions is not considered a commercial sale as it is protected by the 1st amendment of the US Constitution. However, they are prohibited from going to a residence if a "No Solicitation" or "No Trespassing" sign is posted.

Does this ordinance pertain to door-to-door solicitations in commercial locations?

No, the ordinance is only applicable to residential solicitation.

How can I ban all COMMERCIAL AND NON-COMMERCIAL solicitors from coming to my residence?

Posting a "No Solicitation" or "No Trespassing" sign prohibits all solicitations.

What can I do to ban all commercial solicitors from coming to my residence?

A resident must register their address on the "no solicitation" list.

How do I get on the "no solicitation" list?

You may register your address online or in person or by mail.

What if I do not have an e-mail address to register on the "no solicitation" list?

You may register in person or by mail.

How often do I need to renew my registration for the "no solicitation" list?

You will need to re-register every two years. You will be notified by e-mail sixty (60) days prior to being deleted from the list.

How often do I need to renew my commercial solicitation permit?

A commercial solicitation permit is valid for two (2) years from the date of issuance. Permits are not transferable.
