As a condition of receiving a research permit from the City of Fort Collins Natural Areas Department (“the City”), I acknowledge and agree to the following terms, which apply to all activities conducted on City-owned Natural Areas under the scope of my permitted research project.
-
Assumption of Risk:
I understand that access to City-owned Natural Areas may involve inherent risks, including but not limited to:
- Encounters with wild animals (e.g., rattlesnakes, coyotes)
- Uneven or unstable terrain, hidden holes, rocks, and fencing
- Inclement or extreme weather conditions
- Remote locations with limited cell service or emergency access
- Hazards associated with working outdoors, during nighttime hours, or in isolated areas
I understand that the City does not provide supervision, first aid, or emergency services at research sites. I voluntarily assume all risks associated with my research activities on Natural Areas property, including but not limited to bodily injury, illness, death, or property damage, whether caused by natural conditions, my own actions, the actions of others, or the condition of the premises.
I promise to take due care during my research activities and comply with City policies.
-
Release and Waiver of Liability:
To the fullest extent permitted by law, I release and discharge the City of Fort Collins, its officers, employees, agents, and volunteers from any and all liability, claims, demands, or causes of action that may arise from my research activities on City property, whether caused by negligence or otherwise.
I understand that this waiver does not waive liability for gross negligence, willful and wanton misconduct, or other conduct expressly prohibited under Colorado law.
-
Agreement to Indemnify:
I agree to indemnify and hold harmless the City of Fort Collins and its officers, employees, and agents from any claims, damages, or expenses (including attorneys’ fees) arising out of or related to my presence on or use of City property in connection with my research activities.
-
Voluntary Participation:
I understand that participation in research on City-owned Natural Areas is entirely voluntary. I am not an employee of the City and will not receive compensation, insurance, or benefits of any kind from the City. I am solely responsible for the safety, planning, and supervision of my research activities.
-
Compliance with Regulations:
I agree to comply with all applicable rules, permit stipulations, and City policies, including the Natural Areas Rules and Regulations (Fort Collins Municipal Code), and to act respectfully toward wildlife, land, and other visitors.
I acknowledge that failure to comply may result in revocation of my permit and/or denial of future access.
-
Medical Treatment:
I understand that the City does not provide medical treatment or coverage and that I am solely responsible for obtaining any insurance coverage I deem necessary.
I acknowledge that I have read and understand the research permit conditions and the Natural Areas Rules and Regulations. I agree to comply with all applicable City policies, including safety protocols, data submission requirements, and restrictions on group size, trail use, parking, and access hours. I understand that failure to comply may result in immediate revocation of my permit and denial of future permits.
I hereby release, waive, and discharge the City of Fort Collins, its officers, employees, agents, and representatives, from any and all claims, liabilities, demands, and causes of action arising out of or related to any loss, damage, injury, or illness that may occur during or as a result of my research activities, whether caused by negligence or otherwise. I understand that this waiver does not release liability for gross negligence or willful and wanton misconduct under Colorado law.
