HB24-1007 Implementation in Fort Collins#

The City is taking steps to remove code language and ordinances that address occupancy.  This includes language in both the Land Use Code and the Municipal Code. Staff will be presenting information at a Council work session on May 14, 2024, and at the Planning and Zoning Commission meeting on June 20, 2024. The first hearing (regular Council meeting) to amend the codes is scheduled for June 4, 2024.

Nuisance and Code Compliance Complaints#

The City is committed to the health and safety of residents and quality of neighborhoods. Codes and programs that will continue to support these efforts include the International Property Maintenance Code, local nuisance codes, and the Public Nuisance Ordinance. 

Complaints and concerns related to code compliance/nuisance ordinances can be made through Access Fort Collins and submitted directly online or via the free smartphone app.

Previous Occupancy Studies#

In 2016, the City was asked to consider soliciting another study to determine both the effectiveness of the ordinance as well as potential unintended consequences. In 2017, in partnership with Colorado State University (CSU), the Associated Students at Colorado State University (ASCSU), the Board of Realtors (BOR), and neighbors a scope of study was created. Corona Insights was chosen to conduct the study which began in 2018 and was coordinated to work around the academic school year.

Primary questions to be answered

  1. Has the occupancy ordinance had an impact on neighborhood quality?
  2. Does the occupancy ordinance impact the affordability of housing?

 Information on short term rental impacts was also included.

This study, is intended to be a snapshot in time of the rental market and the forces that affect it, with comparisons over time from which the City and the community can identify trends.
